The Terms and Conditions for our SMS Services should be read in conjunction with the general terms and conditions of your Desktop Broker Financial Products Trading Account. The Terms and Conditions which apply to your use of the Desktop Broker Financial Products Trading Account also apply to your use of the SMS Alerts Service, as if the SMS Alerts Service were part of your Desktop Broker Financial Products Trading Account.

The following terms also apply to the SMS Alerts Service.

1. Your use of the SMS Alerts Service is subject to your knowledge and acceptance of our fees associated with sending out alerts, as amended from time to time. Currently these are $0.55 per alert.
2. You will notify us immediately should your mobile phone be lost or stolen and or where your registered mobile phone number is no longer within your control.
3. Desktop Broker does not send or receive the SMS messages itself but uses a third party to do this. You acknowledge that:



1. there may be delays in receiving SMS messages
2. the SMS Alerts Service includes services or components which are supplied by persons not controlled by us and that such persons (each a Service Provider) may change from time to time without any prior notice to you;
3. we are not associated with such Service Providers and do not guarantee their performance of obligations necessary for the SMS Alerts Service to operate: and
4. if you rely on this Service you are responsible for ensuring, by independent verification, the accuracy, completeness and timeliness of SMS message exchanges.
4. To the extent permitted by law, Desktop Broker excludes all liability in contract, tort (including negligence) or otherwise relating to or resulting from use of the SMS Alerts Service and for any Loss incurred by you directly or indirectly including without limitation as a result of or arising out of:



1. any inaccuracy, error or delay in or omission from any information received by you under the SMS Alerts Service;
2. any delays or failures or inaccuracies in the transmission and receipt of SMS for the SMS Alerts Service; and
3. any delay, fault, failure in or loss of access to the SMS Alerts Service.
